Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and SMAart Gallery & Studio ("SMAart," "we," "us," or "our"), located at 1045 Sutter Street, San Francisco, CA 94109. By accessing our website, registering for a class or membership, visiting our studio, or using any of our services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our services.
2. Our Services
SMAart Gallery & Studio offers the following services, each subject to these Terms and any additional terms specific to that service:

Pottery and ceramics classes (single-session, multi-week courses, and workshops)

Studio memberships (Working Artist Member, Class Artist Member, and Drop-in access)

Private events, team-building experiences, and group bookings

Gallery exhibitions and artist member programming

Kiln firing services for members and active students (glaze, bisque, raku, and reserved kiln options)

Retail sales of clay, glazes, tools, and art supplies
-
Artwork pickup, storage, and shipping
3. Registrations and Bookings
Class Registration
All class registrations are made through our online booking system at smaartstudio.com. Registration is complete only upon receipt of full payment. Spots are not held without payment.
Cancellation and Refund Policy

7 or more days before the class: full refund or free rescheduling

3 to 6 days before the class: 50% refund or rescheduling with a 50% fee

Less than 3 days before the class: no refund; rescheduling subject to a 75% fee

Make-up sessions are available within one week of a missed class, subject to availability, and must be confirmed no more than 24 hours in advance
We reserve the right to cancel or reschedule a class due to insufficient enrollment, instructor unavailability, or other circumstances. In such cases, a full refund or free rescheduling will be offered.
Private Events and Group Bookings
Private events and group bookings require a deposit to secure your date. Cancellation terms for private events are outlined in the separate event agreement provided at the time of booking.
4. Studio Memberships
Membership Terms
Studio memberships are available on month-to-month or commitment-based terms as described on our website. By enrolling in a membership, you authorize recurring charges to your payment method on file at the rate and frequency applicable to your membership tier.
Membership Cancellation
Members wishing to cancel must provide written notice to steve@smaartstudio.com at least 7 days before the next billing cycle. Cancellations within the minimum commitment period may be subject to early termination fees as described in your membership agreement.
Studio Access and Conduct
Membership grants access to studio facilities during designated hours. Members are expected to follow all studio rules, maintain a clean and respectful workspace, complete required safety orientation, and comply with all kiln and equipment guidelines. SMAart reserves the right to suspend or terminate membership for violations of studio policies or conduct that endangers the safety or comfort of other members and staff.
5. Payments and Fees
All fees are listed on our website and are subject to change with reasonable notice. Payments are processed securely through our third-party payment providers. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable fees.
All sales are final except as provided in our cancellation policy. We do not offer refunds on materials, glaze supplies, or firing fees once services have been rendered.
6. Artwork, Firing, and Pickup
Firing Services
Kiln firing services are available exclusively to current SMAart studio members and students enrolled in an active class or course. Firing requests from individuals who are not active members or enrolled students will not be accepted. Proof of current membership or enrollment may be required.
Firing services are subject to our current firing fee schedule. We take reasonable care in handling all work submitted for firing; however, we are not liable for damage resulting from the inherent risks of the kiln firing process, including cracking, glaze defects, or breakage due to the properties of the clay or glaze materials used.
Artwork Pickup
Completed work is held for pickup for 90 days from the date of the pickup notification email. Work not collected within 90 days may be discarded, donated, or otherwise disposed of at our discretion. SMAart is not responsible for unclaimed work after the 90-day period.
Shipping
Shipping of completed work is available at the customer's expense and risk. SMAart will package work with reasonable care but is not responsible for damage occurring during transit once the package has been handed to the shipping carrier.
7. Studio Rules and Safety
All visitors, class participants, and members must comply with our studio safety guidelines, which are posted in the studio and available upon request. You agree to:

Follow all posted safety instructions and staff directives

Use equipment only for its intended purpose and only after proper instruction

Clean your work area and tools at the end of each session

Not bring food or beverages into work areas (clay areas)

Supervise any minors in your care at all times

Refrain from disruptive, dangerous, or harassing behavior
SMAart reserves the right to remove any person from the premises for failure to comply with studio rules or for conduct that is unsafe or disruptive.
8. Assumption of Risk
Participation in pottery, ceramics, and art-making activities involves inherent physical risks including but not limited to contact with clay, glazes, and chemicals; use of sharp tools; exposure to kiln heat; and slipping on wet surfaces. By participating, you voluntarily assume these risks and agree that SMAart, its owners, staff, and agents are not liable for injuries arising from ordinary participation in studio activities.
9. Limitation of Liability
To the fullest extent permitted by applicable law, SMAart and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, loss or damage to personal property brought to the studio, or damage to artwork during the firing or handling process beyond our reasonable control.
Our total liability to you for any claim arising out of these Terms or your use of our services shall not exceed the amount you paid to SMAart in the 90 days preceding the claim.
10. Intellectual Property
All content on our website, including text, images, logos, and design, is owned by or licensed to SMAart Gallery & Studio and may not be reproduced without our written permission.
You retain ownership of artwork you create in our studio. By participating in exhibitions, gallery shows, or studio events, you grant SMAart a limited, non-exclusive license to photograph and use images of your work for promotional purposes, including on our website and social media. You may revoke this permission at any time by contacting us in writing.
11. Website Use
You agree to use our website only for lawful purposes. You may not attempt to gain unauthorized access to any portion of our website or systems, interfere with the proper operation of the site, or use automated tools to scrape or harvest data from our site.
Our website may contain links to third-party websites. We are not responsible for the content or privacy practices of those sites.
12. Communications
By providing your contact information, you consent to receive transactional communications from SMAart related to your bookings, membership, and studio activities. Marketing communications, including newsletters and promotional offers, are sent only with your consent and may be opted out of at any time.
We use AI-assisted phone and text messaging services for certain communications. By calling or texting us, you consent to these communications being handled by automated systems. Reply STOP to opt out of text messages at any time.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall first be addressed through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in San Francisco County, California, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on our website with an updated effective date. Your continued use of our services after the effective date of any changes constitutes your acceptance of the revised Terms.
